Changes to Federal Environmental Assessment Rule

A Phase I environmental assessment identifies a site’s potential areas and sources of contamination. The results of the assessment are essential considerations for property acquisition, financing, risk assessment, and development. On November 1, 2006, a new federal rule goes in effect that makes several significant changes to the previous standard for Phase I assessments conducted to achieve specific liability protections (also known as “all appropriate inquiries”).
